ACTION ALERT: Comment to the EPA Opposing the State of California Preemption of the Clean Air Act

The Environmental Protection Agency is currently accepting comments on a request from the California Air Resources Board (CARB) to waive certain Clean Air Act provisions, enabling the implementation of their Advanced Clean Fleets (ACF) regulations.

These regulations, already adopted by the state, mandate the use of zero-emission vehicles starting in 2024 for state and local government fleets, drayage truck fleets, federal agency fleets, and large commercial fleets operating medium- and heavy-duty vehicles, as well as light-duty package delivery vehicles.

Additionally, by 2036, all new medium- and heavy-duty vehicles sold in California must be zero-emission. The ACF regulations also extend to off-road engines and equipment, including off-road yard tractors.

Businesses that rely on trucks for transporting goods and people are aware that effective and reliable zero-emission trucks are not yet widely available. Farms and businesses operating in California, particularly those with unique transportation needs, should provide feedback to the agency.
