The Council of Environmental Quality has published a Federal Register notice seeking public comment on implementing regulations associated with the National Environmental Policy Act. Copied and pasted from the notice is the following:
SUMMARY: The Council on Environmental Quality (CEQ) is considering updating its implementing regulations for the procedural provisions of the National Environmental Policy Act (NEPA). Over the past four decades, CEQ has issued numerous guidance documents but has amended its regulations substantively only once. Given the length of time since its NEPA implementing regulations were issued, CEQ solicits public comment on potential revisions to update the regulations and ensure a more efficient, timely, and effective NEPA process consistent with the national environmental policy stated in NEPA.
DATES: Comments should be submitted on or before July 20, 2018.
NEPA became law on January 1, 1970 was the first major environmental law in the United States. It is often called the “Magna Carta” of Federal environmental laws. NEPA requires Federal Agencies to assess the environmental effects of their proposed actions prior to making decisions. To implement NEPA’s policies, Congress prescribed a procedure, commonly referred to as “the NEPA process” or “the environmental impact assessment process.” The process involves the utilization of environmental assessments (EAs) and environmental impact statements (EISs), which provide public officials with relevant information and allow a “hard look” at the potential environmental consequences of each proposed federal project.
